This website, www.openmindmediation.co.za, is owned and operated by Marique Hopkins, a sole proprietor trading as Open Mind Mediation (“Open Mind Mediation”, “we”, “us” or “our”).

1. Application of these terms

These Terms and Conditions apply to the use of this website and the purchase of digital guides or other products through it.

Mediation, drafting, consulting or other professional services are governed by separate terms or agreements. Purchasing a guide does not engage Open Mind Mediation to provide any professional service.

By using this website or placing an order, you confirm that you have legal capacity to enter into an agreement and accept these Terms and Conditions.

2. General information, not individual legal advice

The website and digital guides provide general legal information, practical guidance and organisational tools relating primarily to South African family law.

They do not constitute legal advice tailored to your circumstances and do not replace advice from an attorney or another appropriately qualified professional.

Using this website or purchasing a guide does not create an attorney-client relationship, mediator-client relationship or professional mandate between you and Open Mind Mediation.

Laws, court practices, official forms and administrative requirements may change and may differ between courts or offices. You remain responsible for confirming the requirements applicable to your matter before taking action.

No particular legal, court, mediation or personal outcome is guaranteed.

3. Digital products

The principal characteristics, contents, format and price of each digital product are stated on its product page.

Digital guides are supplied electronically as PDF documents. No physical product will be delivered unless expressly stated otherwise.

Prices are displayed in South African rand. Open Mind Mediation is not registered as a VAT vendor and does not levy VAT.

4. Orders and payment

Before submitting an order, you will have an opportunity to review the products selected, the total price and the information supplied, and to correct mistakes or withdraw from the transaction.

Payments are processed through Wix and Yoco or another payment provider identified at checkout. Open Mind Mediation does not intentionally collect or store complete payment-card numbers or card security codes.

An order is accepted when payment has been successfully confirmed and an order confirmation or download facility has been issued. We may cancel an order affected by an obvious pricing error, suspected fraud, duplicate transaction or technical failure. If payment has already been received and the order cannot be fulfilled, the amount paid will be refunded.

5. Delivery and transaction records

Digital products are ordinarily made available automatically after successful payment through a download link, confirmation page or email.

You are responsible for supplying a correct email address and checking your spam or junk folder. If the product is not available within one hour after confirmed payment, contact us at marique@openmindmediation.co.za.

Once payment has been verified, we will investigate and restore access or resend the product as soon as reasonably possible, ordinarily within two business days.

Your order confirmation and these terms may be downloaded, saved or printed. We retain transaction records for as long as reasonably required for fulfilment, accounting, legal and dispute-resolution purposes. You may request a copy of an available order record by contacting us.

6. Personal-use licence

Purchasing a guide gives you a limited, non-exclusive, non-transferable licence to use it for your own personal and non-commercial purposes.

You may:

• download and store the guide on your personal devices;
• print a reasonable number of copies for your own use;
• complete, adapt and use worksheets for your own family-law matter; and
• share relevant material with your spouse, former partner, co-parent, mediator, attorney, advocate, social worker, Family Advocate, court or another professional involved in your own matter.

You may not:

• sell, reproduce, publish or distribute the guide or a substantial part of it;
• upload it to a public website, shared drive, social-media platform or file-sharing service;
• provide it to unrelated third parties;
• remove copyright or ownership notices; or
• use it to create or market a competing product.

7. Intellectual property

Unless otherwise stated, the website, guides, written content, designs, graphics, worksheets and branding are owned by or licensed to Open Mind Mediation and are protected by applicable intellectual-property law.

No ownership rights are transferred to you when a guide is purchased.

8. Accuracy, versions and updates

Reasonable care is taken to ensure that the guides are accurate and useful as at the revision or publication date shown in the relevant guide.

A later change in legislation, rules, forms, court practice or official procedure does not by itself mean that the version originally supplied was defective.

A purchase does not include automatic access to future editions or updates unless this is expressly stated.

9. Cancellations, defects and refunds

Purchases are governed by our Digital Products: Delivery, Cancellations and Refunds Policy, which forms part of these terms.

Nothing in these terms excludes or restricts a consumer right that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002 or other applicable law.

10. Privacy and cookies

Personal information is handled in accordance with our Privacy and Cookies Notice.

Third-party platforms, including Wix, Yoco, Google and WhatsApp, may process information in accordance with their own privacy policies when their services are used.

11. Acceptable use

You may not use this website to engage in unlawful conduct, interfere with its operation, attempt unauthorised access, introduce malicious software or infringe the rights of Open Mind Mediation or another person.

12. Third-party websites and services

Links to courts, government bodies, professional organisations or other third-party websites are provided for convenience. Open Mind Mediation does not control those websites and is not responsible for their availability, content or privacy practices.

13. Limitation of liability

To the fullest extent permitted by law, Open Mind Mediation is not responsible for loss arising from:

• treating general information as advice tailored to your circumstances;
• failing to obtain appropriate professional advice;
• incorrect or incomplete information supplied by you;
• a decision or outcome of a court, government office or third party;
• temporary website, email, download or payment-system interruptions outside our reasonable control; or
• changes in legislation, official forms or procedure after publication.

Nothing in these terms excludes liability for gross negligence, intentional misconduct or any liability or consumer right that cannot lawfully be excluded.

 

14. Complaints

Please submit a complaint to marique@openmindmediation.co.za with your name, order number where applicable, and a clear description of the issue.

We will acknowledge and consider the complaint within a reasonable period. You remain entitled to approach a court, the National Consumer Commission or another body with jurisdiction where applicable.

 

15. Governing law

These terms and all transactions conducted through this website are governed by the laws of the Republic of South Africa.

16. Changes to these terms

We may amend these terms when reasonably necessary. The version published when an order is placed will govern that purchase. Updated terms apply to subsequent website use and purchases.

17. General

 

If any provision is unlawful or unenforceable, it will be severed or limited to the minimum extent necessary without invalidating the remaining provisions.

A failure to enforce a provision does not constitute a waiver of that provision.
